TERMS & CONDITIONS

All the content you'll find on W3D is owned by the firm -This includes logos, graphics (site design), images and application or software. Once an order is placed with W3D, you concur that you are in agreement with and bound by the terms and conditions below.

Any work done by W3D for any client – which includes the scripts, coding or software, unless mutually agreed, will be copyright of W3D and should not be commercially reproduced or resold without the knowledge and permission of W3D. The content, digital conversion, organization, graphics, design, compilation, magnetic translation and other matters related to the Website are protected under applicable copyrights, trademarks and other proprietary rights. The copying, redistribution, use or publication by you of any such matters or any part of the Website, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Website. The posting of information or materials on the Website does not constitute a waiver of any right in such information and materials.
Your right to use the Website is not transferable. Any password or right given to you to obtain information or documents is not transferable.
W3D cannot be held liable for copyright violations caused by materials and content submitted by the client.
W3D will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
W3D will not be liable for non execution of project for certain reasons not in control of IT Chimes.
W3D does not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video or music files, Pirated software, hacking programs and any material in violation of any Indian rules and regulations.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of W3D.
Warez - Includes pirated software, ROMS, emulators, phreaking, anything related to hacking, and password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Hosting support on DLL's, COM components, and .exe's are not provided in shared hosting.
This also applies to linking directly to illegal files or other sites that offer any illegal material. Sound and video files that you own the rights to may be uploaded only after you are approved. Midi files are unrestricted; you do not need approval for them. Note: You may upload these materials if you first obtain written permission from the copyright or trademark owner and we will require a copy of this permission before uploading.
If any of the above is found on your site/directory then it will be deleted and you will be emailed with a warning. If a repeat offence is made, your account will be disabled with no refund given. However, if the initial breach of terms is strong enough your account will be immediately terminated. Deliberately changing the extension of a file to hide its contents will not work; it will be considered an illegal file and will result in the immediate termination of your account. You may not publish any material that is grossly offensive to the general on-line community, including but not limited to, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, invasion of privacy or excessive profanity (cursing). This includes material that defames, abuses, harasses or threatens any person or group. Files or directories or email user accounts may NOT contain profane or sexually suggestive names or expletives. We reserve the right to be the final judge as to what is or is not acceptable and to terminate your account if your use of it causes a detrimental effect on other clients.
If your account is disabled due to illegal use on your part your domain name will remain your property but the hosting account will be disabled.
The email system should not be used for mass transfer of data or for virus transfer. We have a no-tolerance approach to SPAM mail being used by any of our members. If you are found to be taking part in SPAM mailing then your account will be terminated, no compensation will be given.
Use of the W3D's service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of W3D's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Subscribers account is subject to immediate termination.
We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.
The amount of server space and bandwidth allocated to your account when you purchased it will always be the minimum value, however we may occasionally increase this value, in which case your account will be upgraded to the new values and you will be contacted regarding this change. Should your account go over your allotted monthly bandwidth, you will be invoiced after the month is complete at the price of Rs.800.00 per 1GB bandwidth used, or part thereof. ( $12 for International clients )
Backup of Data : Your use of the service is at your sole risk. W3D is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on W3D servers, unless otherwise specified depending on the account type.
Payment : You agree to supply appropriate payment for the services received from W3D in advance of the time period during which such services are provided or as per the payment terms of the service opted for, whichever is applicable. You agree that all setup fees are non-refundable once setup is completed.

All payments have to be drawn in favour of “W3D Technologies”, payable at the location of the office of W3D from where the service is bought. W3D shall not be responsible for payments drawn in any other name or location.
Payments are accepted only in the form of crossed Demand Drafts, Cheques or thru Credit Cards .
Charges for all services are payable prior to the beginning of each service period. Failure to pay in no way relieves the Clients obligations to make full payment.
W3D retains full rights to charge for or alter specifications or discontinue any of the services/ features offered under the various schemes at any time, without any prior notice. It shall be our endeavor to set-up the server within 3 working days of the receipt of completed form along with the payment (realization). If however, there is a delay for any unforeseen circumstances, the clients are requested to kindly bear with us. Additional or customized services are available at extra cost as applicable and mentioned in the hosting scheme.
You accept that your account may be temporarily or permanently suspended without any prior notice or information to you in any event of non payment from your side for any of w3D's services.

Use of Information: We reserve the right, and you authorize us, to the use and assignment of all information regarding Website uses by you and all information provided by you in any manner consistent with our Privacy Policy.
Jurisdiction : The agreement shall be governed by Indian laws jurisdiction will be exclusively the courts of law, Surat (Gujarat).
Prior Agreements : This agreement supersedes any written, electronic, or oral communication you may have had with W3D or any agent or representative thereof, and constitutes the complete and total agreement between the parties
All users will be given written notice of any changes to this contract 1 month (30 days) before the change is made. Note that in this contract email is the medium by which the 'written' contract will be sent.
